EXCEPTIONS TO THE RULES AS LAW RESTRICTIONS AND LEGAL PROHIBITIONS

Abstract

Background. The necessity of researching the exceptions is determinated by their atypical nature that permits to implement normative instructions, which act as an alternative to general standards of legal regulation. The exceptions acting as restrictions must be under the special control because a restriction itself is a phenomenon directly connected with limitation of citizens' rights and freedoms. The purpose of the work is to study exceptions acting as restrictions; to stratify such exceptions in detail, particularly to highlight exceptions-prohibitions.
Materials and methods. The set goals were implemented on basis of the study of numerous effective normative legal acts belonging to the legislative system of the Russian Federation. Moreover, the special legal literature referring to the subject of this article was studied. The method of analysis and synthesis, hermeneutics and comparative legal method were chosen as the methodological arsenal.
Results. The nature of the exceptions to the rules that embody legal restrictions was studied. The correlation of exceptions-restrictions and exceptions-prohibitions was examined; the specificity of the latter is shown for the most part of exceptions within the law.
Conclusions. The restriction along with the permission serves as a form of display of exceptions to the rules. A restriction is a complex concept to be distinguished from other phenomena. By projection onto exceptions, one may suggest the following scheme: exceptions-restrictions correlate with exceptions-prohibitions, exceptions-obligations and exceptions-restrictions proper (in the narrow meaning of the word) as a whole and a part.
